SELLERS AGREEMENT

1. The kennel prefix Brancatta’s must be used as the first word of the registered name.
2. The registration is limited ____________.  Puppies sold on limited registration may not be shown in AKC conformation shows or used for breeding.  But may be shown in AKC obedience, performance or field trials.  The Buyer’s understanding and acceptance of this condition is signified here by his/her initials.

1. The purchase price of this puppy/dog will be refunded if the Buyer furnishes the Seller with a veterinary certificate indicating that the puppy/dog is unwell or unsound, and returns the puppy/dog to the Seller within 72 hours of delivery.  No veterinary or shipping costs will be reimbursed by the Seller.
2. If the Buyer has paid by check, the purchase price will be refunded only if or when the Buyer’s check has cleared and been credited to the Seller’s account.
3. The seller is not responsible for any Veterinary bills after the puppy has been delivered to the buyer.
4. The Seller does not guarantee the temperament of this puppy because it is the responsibility on the new owner to properly socialize and train.
5. The Seller does not guarantee against skin problems such as acne, demodectic mange, etc. Or parasites such as fleas etc.  See health record for treatment.
6. The Seller does not guarantee the ears to stand (if applicable), as it is the responsibility of the new owner to properly tape the ears and train them to stand.
7. No warranties or guarantees apply to health related problems caused by nutrition or care, nor any accident or illness not contracted before delivery or possession.  These include but are not limited to HOD (hypertrophic osteodystrophy), OCD (osteochondritis dissecans) and panosteitis.
8. Seller’s warranty applying to genetic disabilities.  These include but are not limited to hip and elbow dysplasia.  Should a dog need to be euthanized due to a genetic defect within the first 2 years of life, the dog will be replaced with a pup of equal value at no charge with the next available litter.  Any shipping costs will be the responsibility of the Buyer.

The puppy/dog is healthy at the time of sale and has the attached health record.

1. Seller in no way guarantees that this puppy/dog shall win in conformation and/or performance events.
2. Seller agrees to provide advice and information on showing and grooming to the best of his/her ability, to help the Buyer of a show or performance potential puppy/dog to present the puppy/dog to its best potential.

No other warranties or guarantees, expressed or implied, are made under this contract except as stated above.

BUYERS AGREEMENT

1. Buyer agrees that if at any time, and for any reason, he/she is unable to keep or properly care for the puppy/dog, the Seller is to be notified an will assist in placing this puppy/dog.  This puppy/dog is not to be turned over to recue/shelter.  There will be no refund to buyer under these circumstances.  The Buyer’s understanding and acceptance of this condition is signified here by his/her initials:

1. The Buyer agrees to maintain the puppy/dog’s health with vaccinations as specified by their veterinarian.
2. Should the puppy/dog become ill or unsound, any and all costs of treatment will be the responsibility of the Buyer.
3. The Buyer agrees to follow the attached “Guide for New Puppy Owners”.
4. The Buyer agrees to feed only those puppy/dog foods acceptable to the Seller.
5. The Buyer agrees to socialize, train and keep the puppy/dog in an acceptable manner.
6. Buyer acknowledges that special coat care, conditioning, training and feeding are necessary to produce a competitive athlete in conformation and performance events.  This care and training is acknowledged by the Buyer to be his/her responsibility.
